MUST BE READ BEFORE THE BOOKING: 


  
“The client(s)” shall be those persons defined in the booking form. In the following terms and conditions “the photographer” shall mean Agnieszka Niewiadomy of Aga Photography. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed upon by the photographer in writing. By booking with the photographer the client(s) agree to the below Terms and Conditions. 
 


Copyright 
All photographs taken during the session will belong to the photographer and are covered under copyrights (Copyright Act 1988 ). This also applies to any content used or featured on any of the photographer's social media accounts, publications and websites. It is forbidden to download, edit, remove watermarks or alter content created by the photographer without permission. Legal action shall be taken against anyone breaching the above terms and conditions.  
The photographer will aim to keep these images safe from any malicious activity but cannot be held liable or accountable for any unforeseen malicious actions carried out by others. 
 


Display 
The client(s) hereby allow(s) the photographer to display any photographic images covered by this 
contract and generally promote the business in advertising, brochures, magazine articles, calendars, websites, photo competitions, sample albums, commercial photography, etc. 



Photography session 
The session will take place at one of Eastleigh's parks. The exact location will be agreed upon before the photoshoot.  The photographer reserves the right to stop the session if there are concerns about the dog’s welfare, safety or behaviour during the session (no refunds provided). It is the client(s) responsibility to make sure that the dog and the client(s} are safe during the session. 
 


Use of your images  
The client(s) cannot enter any of the images taken by the photographer in the competition (online or otherwise) unless the photographer is credited as the author of the image submitted to the contest. The client(s) cannot use the images created by the photographer for any commercial purposes without previously obtaining a copyright release and/or permission from the photographer in writing. This includes any use of the images in books, e-books, or any other use for financial gain. Legal action shall be taken against anyone breaching the above terms and conditions.
The photographer cannot accept any responsibility for poor results obtained from non-authorised third-party printing companies due to the colour, cropping, print quality or any other factor beyond the control of the photographer. 
 


Payment 
£10 deposit is required to secure a booking.  The client(s) can pay the entire session fee, or pay the deposit of £10 first and the remaining balance at least 48 hours before the photoshoot. If the balance is not cleared at least 48 hours before the photoshoot, the photographer will not be attending the session. 
 
The appointment can be changed up to 7 working days before the session. The client(s) are entitled to a maximum of one appointment change up to 7 working days before the session, after which the client(s) will lose the booking fee.

Booking fees are non-transferable and non-refundable. 
 
 
No show – if for any reason after receiving the client(s) confirmation, the client(s) fail to attend the session appointment, the client(s) will lose the full booking fee.  
 


Cancellations 
If the photographer has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid.   
Should weather conditions be deemed unfavourable (upon mutual agreement between the photographer and the client(s), the photo shoot will be rescheduled to suit both parties.  Any concerns regarding the weather will be communicated before the session commences. If both parties come to a mutual agreement, there will be no extra charge for rescheduling the session. If the weather is unfavourable, however, the client(s) insists on going ahead with the session, the client(s) must accept the risk that the quality of the photographs may be compromised. 



Prices 
All services and/or goods are supplied at the current prices ruling at the time of each individual payment and are subject to change without prior notice. 



Digital Files 
When the client(s) purchases digital files, the client(s) are responsible for keeping them safe and making copies. The photographer advises doing at least two copies of the session images using different media types. 
Any request for additional digital image copies from the photographer will incur additional charges. Digital files are provided as JPEG only, edited in the photographer's style.  
The photographer does not provide RAW files. 


Prints & Products
prints and products will be processed and delivered within a month of ordering. The client can either pick up the products from the photographer's address or, depending on where the client(s) lives, the product/s will be delivered by either the photographer or via post.


Other 
Please avoid booking sessions for dogs in season.  
The photographer cannot compensate for any travel costs. Getting to and out of the location of the photoshoot is the sole responsibility of the client(s). 
The client(s) and the dog handler at the time of the session must be 18 or over. 
The photographer doesn't provide a telephone number for personal preference. However, always endeavours to respond to client(s) emails within 48 hours.
The photographer can't be responsible for uncooperative subjects. The final number of digital images will depend on which package the client(s) chooses and how well the subject cooperates during the session. 


Refund Policy 
The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as the photographer cannot be held responsible for individual tastes or exceptions. 
 
 
The photographer will keep the images on file for up to three months after which the images may be deleted. 



Complaints 
Any complaints should first be raised by the client(s) with the photographer in writing within 14 days from the date of receipt of images. 
 
 
The Photographer reserves the right to amend these Terms and Conditions without prior notice.
